General License Terms

This license is made effective by and between the following parties:

  • The Artist – (“KryptidiKettu”)
  • The Purchaser – (You!)

All copyrights that have not been separately given by agreement remain with the Artist and this does not limit any rights belonging to the author according to the Copyright Act (https://www.finlex.fi/fi/laki/kaannokset/1961/en19610404_20150608.pdf). The name of The Artist and the artwork must always be given in accordance with good practice when using images of the work.

The use of the work for commercial purposes must be agreed with the Artist separately.

  • The Artist retains the right to revoke any parts of this license at will.
  • The Artist retains the right to modify this license at will.
  • The Artist retains the right to distribute, make public and sell copies of the artwork.
  • The Artist retains all copyright to the artwork.

The Purchaser does not acquire the right to use the work in violation of The Artist’s moral rights. If reproduction of the work has been authorized by agreement, the name of The Artist and the work must always be stated when the work is reproduced.

The Artist is responsible for ensuring that the work or part of it does not in any way infringe the copyright or other intellectual property rights or other intellectual property rights of third parties. The Artist further warrants that the Artist has the sole right to dispose of the work and/or related works covered by this Agreement and that no other rights or claims apply to the work or related rights and that no agreement is required for any other party to agree on the work or related rights.

  • The Purchaser is NOT permitted to produce digital or physical copies of the artwork for the purposes of redistribution.
  • The Purchaser is NOT permitted to redistribute the artwork.
  • The Purchaser is NOT permitted to modify the artwork.
  • The Purchaser is NOT permitted to use the artwork for commercial purpose.
  • The Purchaser is permitted to produce personal physical copies or prints of the artwork for the purposes of personal and private viewing in a private location.

This license shall be governed by and construed in accordance with the laws of the Republic of Finland. Any disputes arising under or in connection with this license shall be subject to the exclusive jurisdiction of the courts of the Republic of Finland.

Commission Contract

This commission contract is made effective by and between the following parties:

  • The Artist – (“KryptidiKettu”)
  • The Purchaser – (You!)

This contract sets forth the terms and conditions whereby The Artist agrees to create The Artwork for The Purchaser. The Purchaser has commissioned The Artwork.

The Artist will be engaged solely and exclusively for the limited purpose of creating The Artwork for The Purchaser.

This contract shall be governed by and construed in accordance with the laws of the Republic of Finland. Any disputes arising under or in connection with this contract shall be subject to the exclusive jurisdiction of the courts of the Republic of Finland.

License

All terms listed in “General License Terms” are still in force with the following exemptions and limitations:

The Purchaser is allowed to redistribute the artwork they have purchased to social media platforms. The Purchaser MUST NOT claim the artwork to be done by The Purchaser. The Purchaser is allowed to use the artwork as a profile picture on social media platforms.

The name of The Artist and the artwork must always be given in accordance with good practice when using images of the work. An example of good practice is “Art by KryptidiKettu”. If the social media platform allows longer messages, The Purchaser should include a link to one of the active profiles of The Artist.

The Purchaser is allowed to make minor modifications to the artwork by themselves with written approval for the changes from The Artist. Minor modifications are, for example, changes to the background.

Major modifications to the commissioned work can only be requested before the sketch has been approved. The commissioned artwork is provided on an “as is” and “as available” basis. The commissioned work cannot be returned or refunded.

Employment

Neither party is, by virtue of this contract, authorized as an agent, employee or legal representative of the other. Except as specifically set forth herein, neither party shall have the power to control the activities and operations of the other.

Nothing contained herein is to establish an exclusive relationship between the parties. The Artist is free to continue working for and taking on new commission orders without regard to The Purchaser. The Artist does not need approval from The Purchaser for any such work.

Payment

The Purchaser must complete any payments within 14 days after The Artist has sent the invoice.

Commissioned works are paid as decided on a case-by-case basis either in whole after the sketch has been approved or in two instalments: 1/2 of the full payment before the start of the work and 1/2 of the full payment after The Purchaser has approved the final rendering.

Delivery

The Artist will deliver the final commissioned work after it has been completed and the last instalment has been paid by The Purchaser and confirmed as received by The Artist. The Artist is not responsible for any delays caused by the financial institutions used by The Purchaser or The Artist.

Termination

The commission contract will terminate once the full payment has been completed.

If any payments are not completed within 14 days after The Artist has sent the invoice, the commission is considered as cancelled and the commission contract will terminate.

The commission contract will be considered terminated if the commissioned work is cancelled by either party.

Cancellation

The commissioned work can be cancelled before the first payment without any fee.

If The Purchaser wishes to cancel the commission after the first payment instalment, they MUST pay 1/4 of the full payment as a cancellation fee.

If The Artist wishes to cancel the commission after the first payment instalment, they MUST issue a refund to The Purchaser for the paid instalment.

Cancellation is communicated by either party in writing.

Deadline

Deadline of The Artwork will be negotiated separately in a case-by-case basis. The Artist will ensure that The Purchaser is aware of the status of their order and of any delays.

Notices and communication

All communication shall be in writing. All communication between the parties is handled via email or via Discord.

Force Majeure

The Artist is not liable for any failure to perform due to causes beyond their reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts wich may be due to unforeseen circumstances.
